Mary Grace murder: Supreme Court orders review of Lamha’s release

The Supreme Court on Wednesday instructed the High Court to revisit Haleemath Lamha Abdul Rahman's case, who was granted bail despite facing murder charges connected to Filipino nurse Mary Grace.
The ruling came after the prosecution appealed against the High Court's refusal to register the case and decision to uphold Lamha's release on bail.
Lamha had been in custody when granted bail on November 12, 2023. The prosecution challenged this decision to overturn the Criminal Court's ruling. The High Court chose not to pursue the matter, prompting escalation to the country's highest judicial body.
The Supreme Court declared the High Court erred in refusing to hear the case and ordered an investigation into Lamha's release circumstances.
The case involves Mary Grace's death, a nurse in the dialysis department of Indira Gandhi Memorial Hospital (IGMH). Her husband, Marvin SY Vargas, reported it as suicide on October 19, 2021. However, police investigation revealed evidence suggesting foul play.
Vargas was arrested on October 27, 2021, for suspected murder. On December 16, 2021, Lamha was detained and charged as a co-conspirator.
The November 2023 bail release has drawn criticism given the charge severity. Her remand was ordered by the High Court in December 2021, and she remained in custody until the bail ruling.
The prosecution argues that releasing Lamha undermines the judicial process, raising concerns about fairness in high-profile cases.
The Supreme Court review is expected to clarify whether procedural errors contributed to Lamha's release.
