Maldives strengthens legal framework for challenges in criminal procedure

The Fifth Amendment to the Criminal Procedure Act, ratified and published in the Government Gazette on Tuesday, introduces several pivotal updates to the existing legal structure.

The Amendment introduces significant reforms to the legal framework of the Maldives, addressing issues such as bail procedures, cybercrime, and financial fraud.

A key element of the Amendment – the comprehensive reform of the bail system – provides new guidelines for granting bail during investigations and trials, while also specifying the circumstances under which convicted individuals may request bail. It also introduces a clear process of ensuring fairness and transparency within the justice system.

The Amendment also seeks to combat the growing prevalence of cybercrime. The legislation empowers law enforcement agencies to intercept personal information in cybercrime investigations, provided they obtain a court order. It also formalises access to subscriber and communication data retained by service providers, ensuring that investigations can keep pace with technological advancements. The Amendment calls for the establishment of a real-time data-sharing system to be developed collaboratively by financial authorities and law enforcement agencies.

Another significant provision of the amendment focuses on preventing financial scams in the country. Law enforcement and financial authorities are now empowered to freeze assets and halt financial transactions of suspects involved in scams. This measure is designed to prevent the misuse of funds and provide swift protection to victims, ensuring that fraudulent activities are curtailed at the earliest opportunity.

The Fifth Amendment to the Criminal Procedure Act, ratified by President Dr Mohamed Muizzu, is a bold step towards strengthening the Maldives’ capacity to address contemporary legal challenges while safeguarding the rights of its citizens.
