The Maldives has reaffirmed its stance against the relocation of citizens due to climate change whilst calling for greater international support for vulnerable nations. This position was articulated during oral submissions presented yesterday at the International Court of Justice (ICJ) in advisory proceedings titled 'Obligations of States in respect of Climate Change.'
During the ICJ's 77th session, the advisory proceedings adopted Resolution 77/276, titled 'Request for an advisory opinion of the International Court of Justice on the obligations of States in respect of climate change.' The General Assembly resolved to seek an Advisory Opinion from the ICJ under Article 65 of the Court's Statute. The hearings, open to participation from states and international organisations, allow parties to present their positions on the issue.
Representing the Maldives, Attorney General Uz Ahmed Usham highlighted President Dr Mohamed Muizzu’s leadership in advocating for climate-vulnerable nations. He stressed the Maldives’ acute vulnerability to the gradual and devastating impacts of climate change, reaffirming the government's commitment to protecting its citizens without resorting to forced relocation. He also called on the international community to honour its legal and moral obligations to support Small Island Developing States (SIDS) like the Maldives.
Further strengthening the Maldives’ case, international legal experts representing the country expanded on the mandatory obligations under the climate treaty regime. They underscored the necessity for states to cooperate and provide assistance to developing nations, as required under customary international law. Their submissions argued that the international community has a collective responsibility to help SIDS adapt to the environmental changes brought about by climate impacts.
In a statement following the hearing, the Attorney General’s Office reiterated the Maldives’ unwavering resolve to combat the climate crisis in collaboration with global partners. “The Government of Maldives stands steadfast in its commitment to work with the international community to address the climate crisis,” the statement read, emphasising the country’s dedication to safeguarding its citizens and securing climate justice.
This ICJ hearing marks a pivotal moment in the Maldives' efforts to hold countries accountable for their environmental responsibilities, while reinforcing the nation's ongoing campaign to secure vital support for climate-vulnerable nations.
