Maldives Penal Code amended to tackle cybercrime

The Maldives has introduced landmark reforms to its Penal Code with the ratification of the Sixth Amendment on December 17, 2024.
The Amendment, passed by the Parliament on December 9, 2024, and ratified by President Dr Mohamed Muizzu, formally integrates cybercrime into the nation’s legal framework, recognising and criminalising a range of activities tied to digital offences. These include:
1. Unauthorised access to computer systems
2. Accessing unauthorised computer systems with the intention of committing a crime
3. Intercepting unauthorised data on computer systems
4. Interfering with unauthorised computer systems
5. Misuse of computer systems or similar devices
6. Acts of cyber violence
7. Computer-related forgeries
8. Acts of fraud and misrepresentation related to computer systems
9. Infringement on copyright and associated rights
This Amendment modernises the country’s approach to justice by addressing the growing risks posed by the digital era. The changes provide law enforcement and judicial authorities with the tools needed to deter and penalise cybercriminals effectively, while ensuring greater protection for individuals, businesses, and institutions, reinforcing public trust in the security of digital systems
Key additions, such as provisions against computer-related fraud and copyright infringement, highlight the focus on safeguarding both personal and systemic interests. These measures aim to mitigate risks to financial integrity and intellectual property while strengthening the Maldives’ ability to engage confidently in the global digital economy.
By enacting these measures, the Maldives has taken a critical step toward enhancing cybersecurity and addressing the evolving challenges of a rapidly digitalising world.
