PNC welcomes Supreme Court ruling upholding on anti-defection

The People’s National Congress (PNC) has welcomed the Supreme Court of the Maldives decision to uphold the Sixth Amendment to the Constitution, which prohibits Members of Parliament from switching political parties after being elected.
In a statement, the party said the ruling affirms the principle of anti-defection, noting that similar provisions exist across democratic systems globally, including those operating under presidential frameworks. The PNC highlighted that the Court recognised such measures as important in maintaining political accountability and electoral integrity.
The party further stated that the Supreme Court found the restriction on party switching does not violate any constitutionally guaranteed rights of Members of Parliament. It added that the ruling reinforces the sanctity of the electoral mandate, ensuring that the basis on which representatives are elected is not altered.
According to the statement, the Court also noted that anti-defection measures are widely practiced in democratic societies to strengthen the integrity of elected representatives and enhance accountability to the public. The PNC said the amendment reflects efforts to address long-standing issues in the political system, including instability linked to floor-crossing.
The party added that the amendment, proposed by the 20th Parliament in which it holds a majority, aims to strengthen the political system, uphold democratic principles and restore public confidence in the legislature. It also reiterated its commitment to governance in line with democratic values and the interests of the Maldivian people.
