New rules require MFDA approval for food advertisements in Maldives

The Maldives Food and Drug Authority (MFDA) has been granted the power to take action against unauthorised food advertising, following the implementation of new regulations under the Food Safety Act.
The rules, published in the Government Gazette on February 20, 2025, outline the standards and requirements for food advertising in the Maldives.
Under the new regulations, businesses must submit advertisements to the MFDA and obtain written approval before they can be published. Any unauthorised food advertising or alterations to previously approved advertisements are strictly prohibited. Additionally, advertisements that claim health benefits or suggest that a food product can treat or cure diseases are not allowed.
Violating the advertising regulations is considered an offence, with penalties imposed based on the severity and frequency of violations. The first offence carries a fine of MVR 10,000, while a second violation results in a fine of MVR 100,000. A third offence will incur a fine of MVR 300,000, and any subsequent violations will be penalised with a fine of MVR 500,000.
The MFDA also holds the authority to impose the maximum fine for a first-time offence if an individual or entity fails to comply with the regulations after receiving a formal notice.
With the rules now in effect, the MFDA has the legal framework to enforce food advertising standards and ensure that misleading or unapproved advertisements are effectively addressed.
