Parliament passes amendment to allow bail during appeals

The Parliament has passed a significant amendment to the Criminal Procedure Code, enabling convicted individuals to seek bail during the appeals process.
The amendment, proposed by Manadhoo MP Husnee Mubarik on behalf of the Government, marks a substantial shift in the legal landscape for those appealing their convictions.
The bill was approved in the Parliament with 58 lawmakers expressing their support. The amendment introduces a framework outlining the specific circumstances under which bail can be granted at the appeal stage, as well as the procedures to be followed in such cases.
According to the revised law, individuals appealing their convictions can apply for bail during the appeals process. However, the amendment also emphasises strict limitations for serious offences.
Convictions involving crimes such as murder, drug trafficking, and child sexual abuse are explicitly excluded from the provision, ensuring that those charged with severe crimes remain ineligible for bail during their appeals.
The new provisions aim to strike a balance between safeguarding the rights of individuals seeking justice and protecting public safety by restricting bail for the most grievous offences.
Legal experts have suggested that this amendment could help streamline the appeals process, offering convicted individuals a temporary reprieve while their cases are under review.
