Supreme Court to deliver verdict Wednesday on anti-defection case

The Supreme Court is set to deliver its verdict on Wednesday in a constitutional case challenging provisions that require Members of Parliament to vacate their seats if they leave or are expelled from their political parties.

The case was filed by former Member of Parliament for Kendhoo Ali Hussain, who argues that the constitutional amendment is inconsistent with the Constitution. The amendment, passed by the People’s Majlis, mandates that MPs lose their seats if they resign from or are dismissed by the party under which they were elected.

Hearings in the case have concluded, with the court scheduling the verdict to be delivered on Wednesday morning. The case is being heard by a full bench of seven judges, led by Chief Justice Uz Abdul Ghanee Mohamed.

During proceedings, Ali Hussain sought an interim order to prevent the loss of his parliamentary seat pending the verdict. However, the court declined the request, stating that issuing such an order would affect the substance of the case. The court also noted that such decisions must align with principles that prevent judges from ruling on matters tied to their own interests.
